Thanks for entering our sweepstakes for a chance to win a Pioneer DJ DDJ-800, a Pioneer DJ HDJ-X5BT headphones and (10) Specialty Releases by Promo Only. Entering is simple, take a picture of yourself holding up your song choices and upload it to Instagram with #PioneerDJCares and #PromoOnlyCares in the description. No printer, no problem, write your song choices on your own paper. Your post must be able to be viewed publicly to enter; posts made by private accounts are not eligible to win.

Agreement to Rules
By participating in the sweepstakes, you fully and unconditionally agree to and accept these Official Rules and the decisions of Promoters, which are final and binding in all matters related to the sweepstakes.

Prize Drawing Terms & Conditions
The prize for the one (1) winner consists of one (1) Pioneer DJ DDJ-800 valued at $799, (1) Pioneer DJ HDJ-X5BT valued at $149, and (10) Specialty Releases by Promo Only valued at $250 for a total of $1198 for all prizes for the winner. Prizes are not transferable and are not redeemable for cash. Sweepstakes available only in the USA. Only one entry per person will be accepted.

Open to legal U.S. or D.C. residents 18 years of age or older, except for residents of Rhode Island. The Sweepstakes is subject to all applicable federal, state and local laws and regulations, and is void where prohibited by law. Employees, officers, directors and contractors of AlphaTheta Music Americas, Inc. or Promo Only Inc. (collectively, “Promoters”), or affiliates, subsidiaries, agents, vendors, dealers, or distributors, and family and/or household members of any of the foregoing, are ineligible to participate.

At 11:59 pm Pacific Time on July 31st, 2020, the Submission Period is over. Promoters will then randomly select the one (1) potential winner and contact the potential winner via the potential winner’s Instagram Direct Message. You are limited to one (1) entry in the sweepstakes, irrespective of how many submissions you post. You may not participate with multiple Instagram accounts or use any device or artifice to enter multiple times. Any entrant who attempts to enter with multiple Instagram accounts, email accounts, or using any other device or artifice to enter multiple times will be disqualified. Promoter’s decision will be final. If the potential winner chooses not to accept the prize or execute a W-9 and affidavit of eligibility and release, or does not respond to two separate attempts to reach the potential winner within a one (1) week period, another randomly selected entry will be selected as the potential winner. Promoters are not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify the potential winner. Promoters may require reasonable proof of the authenticity of the entry.

Odds of winning will depend on the number of eligible submissions at the time of the drawing.

Prizes are non-transferable and no substitution will be made unless Promoters, in their sole discretion, determine otherwise. Promoters reserve the right to substitute any prize for one of equal or greater value for any reason.

License Grant and Waiver: If selected as a winner, as a condition of accepting the prize, you also agree to grant Promoters and their affiliates and agents an exclusive, royalty-free license to copy, display, distribute, or otherwise use your submission, as well as use your Instagram account name, and name and likeness in connection with the sweepstakes of the Sweepstakes, except where prohibited by law, and you agree to execute any documents reasonably requested by Promoters in connection with such grant of permission and license. You will indemnify Promoters, Released Parties (as defined below) and any licensee of Promoters against all claims, damages, liabilities, and expenses (including reasonable counsel fees and legal expenses) arising out of any breach of these Official Rules.

Taxes and Documentation: All federal, state, and local taxes on the monetary value of the prize are the sole responsibility of the winner. A 1099 tax statement will be filed with the IRS and the winner will be required to sign a W-9 form and an affidavit of eligibility and liability release. Failure to do so will result in forfeiture of the prize.

Release: YOU AGREE THAT THE PRIZES ARE BEING PROVIDED “AS IS,” AND PROMOTERS DO NOT MAKE ANY WARRANTY, REPRESENTATION, OR GUARANTEE REGARDING ANY PRIZE, INCLUDING BUT NOT LIMITED TO ITS QUALITY, CONDITION, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. You must look solely to the manufacturer for any such warranties or guarantees.

By entering the Sweepstakes, you release and agree to hold harmless Promoters, Instagram, and their suppliers, parents, affiliates, subsidiaries, and their officers, directors, employees, representatives, agents, advertising, sweepstakes, production and fulfillment agencies, successors and assigns (collectively, “Released Parties”) from and against any liability of any kind in connection with the Sweepstakes and use of the prizes. Promoters reserve the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Promoters’ reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Promoters in their sole discretion. Promoters, in their sole discretion, reserve the right to disqualify any individual they find to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other sweepstakes or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Promoters reserve the right to seek damages from any such person to the fullest extent permitted by law. Promoters’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

You expressly waive Section 1542 of the California Civil Code, which provides that:

“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by you, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in internet connections or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the Sweepstakes or receipt or use or misuse of any prize. Promoters are not responsible for misdirected or undeliverable entries or for any technical problems, malfunctions of computer systems, servers, 3rd party providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Promoters are not responsible for any typographical/other error in entries, selection announcement or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with this Sweepstakes. If for any reason your submission is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, your sole remedy is another submission. No more than the stated number of prizes will be awarded.

Disputes: Except where prohibited, you agree that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the courts within Los Angeles County, California, U.S.A.; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or your rights and obligations, Promoters, or Released Parties in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
